Public Domain Calculator Expert Questions

1. What are the laws, treatises and other documents relevant to copyright and related rights in force in your national jurisdiction and where can they be found (urls)?

2. Are collective works, works of joint authorship and compilations given a definition in your national act? If so how are they defined? What is the term of protection for each of these different categories of work? Are their individual components considered to be separate works with an independent term of protection or not? E.g. co-written musical works may be treated as separate works, likewise for multiple episodes of a television series

3. Are there situations (not shown in the flowchart) where a single item has components which are individually protected as separate works? E.g. multiple episodes of a television series may be treated as separate works.

4. Are there categories of works of copyright that result in different protection from that shown in the flowchart? E.g. government material or cinematographic or audiovisual works may receive special treatment.

5. [FC:1] What is the term of protection for subject matter protected by rights akin to copyright, such as related rights in sound recordings and films, the sui generis right for unoriginal databases, the sui generis rights for non-original photographs? Can you think of any other category of subject matter that is protected by rights akin to copyright in your jurisdiction?

6. [FC:2] What are the author categories that result in different protection? E.g. is a different term of protection established if the author is anonymous or pseudonymous or if the author is a legal entity or a civil servant?

7. [FC:4] How does the date of publication affect (the term of) protection? Is additional protection provided for works that are first published after the expiry of copyright protection? E.g. in Spain pre-1987 works received life+80, in the US all works pre 1923 are public domain

8. [FC:5/6/7/8]: How does citizenship/residency/place of publication affect the calculation of the term of protection? Had your country accepted any international obligations granting a different term of protection to certain foreign works on the basis of their country of origin?

9. Please give the dates at which the term of protection provided for in your national legislation was last changed. Were there any cases of previously expired rights over works in which copyright or related rights subsist being resuscitated? Are they any special transitional provisions (e.g. for older material) in force? e.g. in Spain pre-1987 works received life+80, in the US all works pre-1923 are in the public domain.

11. Can you think of any other unusual or noteworthy provisions on the term of protection of works of copyright and subject matter protected by rights akin to copyright (neighbouring rights, sui generis rights, etc.) in your country? E.g. in France works made during the First and Second World Wars are granted longer protection.
